India Crypto Landscape: Regulatory Framework, Market Activity and Future Outlook
India ranks first in global crypto adoption while taxing Virtual Digital Assets at 30 percent plus 1 percent TDS. This report maps regulation, taxation, markets, enforcement, the Digital Rupee, and outlook through early 2026.
Executive Summary
A comprehensive overview of India's crypto landscape as of February 2026
India occupies a singular position in the global cryptocurrency landscape - simultaneously the world's largest crypto user base and one of its most fiscally punishing jurisdictions to trade in. As of early 2026, India holds the #1 rank in the Chainalysis Global Crypto Adoption Index for the third consecutive year, a position earned not through regulatory support but despite formidable obstacles: a 30% flat capital gains tax with no loss-offset provisions, a 1% transaction-level TDS, and the absence of any comprehensive crypto legislation after nearly a decade of policy deliberation.
The regulatory picture is defined by its deliberate incompleteness. The Finance Act 2022 created a robust tax identity for Virtual Digital Assets (VDAs), while the March 2023 PMLA amendment brought crypto exchanges under the Anti-Money Laundering framework - compelling foreign giants like Binance (fined ₹18.82 crore) and Bybit (fined ₹9.27 crore) to register with FIU-IND. Yet there is no Crypto Act, no exchange licensing regime, no investor protection law, and no formal classification of crypto as currency, commodity, or security. The Finance Ministry confirmed in Parliament on February 6, 2026 that "no proposal is currently under consideration to completely regulate or ban cryptocurrency."
The market realities are dramatic. India's crypto user base of approximately 119 million people transacted $338 billion on-chain between June 2024 and June 2025. Yet domestic exchanges have seen 72.7% of Indian trading volume migrate to offshore platforms - a direct consequence of the 1% TDS making frequent trading economically unviable on regulated exchanges. The Esya Centre estimates cumulative uncollected TDS since July 2022 at over ₹6,000 crore ($724 million), a fiscal paradox: the government collects less revenue because its tax rate is too punitive.
The WazirX hack of July 2024, in which North Korea's Lazarus Group stole $235 million from India's largest exchange at the time, exposed profound structural weaknesses in India's crypto infrastructure - no mandatory custody standards, no investor compensation scheme, and no clear regulatory path for resolution. The exchange's Singapore court-supervised restructuring and eventual relaunch in October 2025 provided partial relief to 350,000+ affected users but underscored the consumer protection vacuum at the heart of India's approach.
India's Enforcement Directorate has been the most active arm of the regulatory machinery, attaching ₹4,189.89 crore in crypto-linked proceeds of crime, arresting 29 individuals, and declaring BitConnect's Satish Kumbhani a Fugitive Economic Offender. The I4C flagged 27 exchanges as potential money laundering channels, with ₹623.63 crore siphoned through them in just 21 months. On the constructive side, the Digital Rupee (e₹) has reached 7 million users across 19 banks in 25+ cities, with ₹1,016 crore in circulation - but this is a fraction of the 119 million private crypto users it is meant to eventually supplant.
Five Key Takeaways
- India has neither banned nor formally legalized cryptocurrency - it exists in a regulatory grey area governed by tax law (Finance Act 2022) and AML compliance (PMLA 2023 amendment), with no comprehensive Crypto Act and the government explicitly stating "no fixed timeline" for one.
- The 30% tax + 1% TDS regime is fiscally self-defeating: it drove 72.7% of trading offshore, resulting in an estimated ₹6,000+ crore in uncollected TDS - far exceeding the ₹1,096 crore actually collected from domestic exchanges.
- India's FATF compliance is strong (37/40 Recommendations largely compliant), and FIU-IND enforcement - blocking 9 exchanges, imposing ₹28 crore in penalties - demonstrates the AML framework has teeth, but VASP supervision remains newly established.
- The Digital Rupee (e₹) has reached 7 million users vs. 119 million private crypto users, revealing a massive gap between the government's CBDC vision and the lived reality of India's crypto adoption.
- India is simultaneously the world's #1 crypto adopter and home to one of the world's largest developer communities (17% of new global Web3 developers in 2024), yet regulatory uncertainty is accelerating brain drain to Singapore, Dubai, and the US.

The Reserve Bank of India issued its first formal regulatory statement on cryptocurrency on December 24, 2013 - a public notice cautioning "users, holders, and traders of virtual currencies (VCs), including Bitcoin" about financial, operational, legal, customer protection, and security-related risks. Key concerns: VCs are not authorized by any central bank; no framework for resolving customer disputes; vulnerability to hacking and password loss; no regulatory oversight for exchanges. Follow-up advisories: RBI issued further cautionary press releases on February 1, 2017 and December 5, 2017 (the December 2017 advisory was issued jointly with the Ministry of Finance).

The wallet used a 4-of-6 signature scheme: 5 keys held by WazirX team members (hardware wallets/Ledger), 1 HSM key from Liminal Custody. Attackers practiced on non-WazirX contracts 8 days before the actual breach. On July 18, three WazirX signers accessed Liminal's platform via bookmarked links, authenticated via MFA, and approved what appeared to be routine GALA and USDT transfers - but the actual payload was a malicious smart contract upgrade (man-in-the-middle attack via forged transaction details in the Liminal UI). When Liminal provided the 4th required signature, the upgrade executed and the wallet was fully drained.

Regulatory Uncertainty
No comprehensive crypto law; fragmented approach (tax law, PMLA, RBI advisories) creates compliance ambiguity DEA consultation paper delayed repeatedly (expected Sep 2024; still pending Feb 2026) Supreme Court's May 2025 warning about regulatory vacuum highlights urgency Jurisdictional overlaps between RBI, SEBI, FIU, ED, and CBDT create enforcement inconsistencies

Emerging Technology Trends
India has strong potential due to its IoT ecosystem and need for distributed infrastructure (telecom towers, energy grids, data centers). Early-stage as of 2026 - no significant Indian DePIN projects at scale, but developer interest is growing rapidly. Policy barrier: without regulatory clarity on token issuance, Indian DePIN projects list tokens offshore.
IFSCA released a consultation paper on RWA tokenization on February 26, 2025. SEBI's DLT mandates for debenture covenant monitoring have created early RWA infrastructure. Polygon PoS already has $271M+ in tokenized real-world assets (BlackRock, JPMorgan, Apollo products). Land registry tokenization actively piloted in Andhra Pradesh, Telangana, and Amravati (with Polygon). IndusInd Bank completed programmable CBDC transactions for carbon credits in April 2024.
India's large AI developer community is exploring AI agent wallets, automated DeFi strategies, and on-chain AI applications. Several Indian Web3 startups are building AI-powered compliance and fraud detection tools for crypto exchanges. India's Blockchain India Challenge (2025) by MeitY/C-DAC is funding permissioned blockchain solutions for governance. No specific regulatory guidance on AI + crypto from Indian regulators as of early 2026.
